Insolvency Proceedings and ICANN Notice of Breach[edit | edit source]
In early April 2019, ICANN became aware of the insolvency proceedings against the registrar Net 4 India Limited (IANA 1007).[5] ICANN began taking actions to protect registrants, such as enforcing applicable contractual obligations against Net 4 India and providing guidance to registrants. ICANN received complaints concerning Net 4 India unresponsiveness to transfer and renewal requests and registrant-provided updates to WHOIS registration data. ICANN observed registrant confusion over Net 4 India acting as reseller for another registrar, Hosting Concepts B.V., and doing business as Openprovider.[6]
On April 23, 2019, ICANN Contractual Compliance sent an Escalated Notice to Net 4 India and a Notice of Suspension on June 5, 2019, which suspended Net 4 India’s ability to register or initiate inbound transfers of domain names for 90 days.
On June 20, 2019, ICANN postponed the start date of the Suspension Period after considering the insolvency proceedings but maintained the Notice with the RAA violations and its cure requirements. The court-appointed resolution professional for Net 4 India was required to provide status updates on the proceedings. ICANN granted extensions to the Notice's deadline because the registrar appeared to continue to provide registrar services and the resolution professional provided updates.[7]
By September 30, 2020, ICANN Contractual Compliance had received more than 400 complaints against Net 4 India by registrants, third parties, and ICANN monitors. Over 70 percent of them were received between August and September 2020. Approximately 74 percent of the complaints were closed because the issue was resolved or beyond the scope of the Notice.[8]
On December 10, 2020, ICANN Contractual Compliance issued a Notice of Breach of Net 4 India Limited’s Registrar Accreditation Agreement (RAA).[9] The notice addresses RAA violations mentioned in complaints submitted to ICANN Contractual Compliance or observed directly by ICANN. The registrar must resolve all breaches by December 31, 2020. Otherwise, ICANN may initiate the RAA termination process. The breach notice does not cover complaints that are currently in the informal resolution phase.
On May 11, 2021, ICANN announced that Net4India's domain names would be transferred to PublicDomainRegistry.[10]
