Internet Policy and Domain Name Counseling Services

For as long as he has been in practice, Phil has actively shaped Internet policy through his participation in the Internet Corporation for Assigned Names and Numbers (ICANN). He routinely counsels and collaborates with clients on all manner of policies, regulations, and legislation impacting the Internet, with a particular emphasis on the domain name system. Phil regularly partners with Internet intermediaries to identify and limit their liability, determine acceptable legal and compliance risks, and align their legal strategies with their business goals. Phil is one of only a handful of attorneys worldwide who has assisted his clients through the successful application, evaluation, dispute resolution, contracting, delegation, and operation phases of over two-hundred new generic Top-Level Domain Names (gTLDs). He also manages global domain name portfolios for his clients, and has developed and executed strategies for the acquisition, management, and operation of all manner of domain names.

Intellectual Property Prosecution and Brick-And-Mortar Enforcement Services

Phil handles all aspects of global copyright and trademark selection, clearance, prosecution, management, and enforcement. He provides regulatory and litigation counseling on all manner of trademark, copyright, social media, ecommerce, intermediary liability, and right of publicity matters. Phil has litigated cancellation and opposition proceedings before the US Trademark Trial and Appeal Board. And he has negotiated a wide array of coexistence, consent, and settlement agreements.

Licensing, Ecommerce, and Transactional Services

Phil routinely drafts and negotiates agreements related to the creation, licensing, and assignment of rights in intellectual property, data, domain names, and various other technologies and intangible assets. He handles all manner of high-value technology licenses, vendor service agreements, sponsorship agreements, naming rights agreements, confidentiality agreements, escrow agreements, and auction agreements, as well as website policies, terms and conditions.

Other Services

Phil is embedded in the legal department of an international trade association that focuses on information technology and cybersecurity and offers a number of well-known certifications and educational products and services.  In that role, Phil handles all manner of intellectual property licensing and commercial transactions, and Phil also helps oversee their global trademark and copyright prosecution and enforcement matters.
