.ECO(R), planet.ECO LLC's is an applicant for the .eco TLD. Its mission is to "connect people, communities and organizations who work collaboratively to advance the sustainability of the planet." [1]
New gTLDs[edit | edit source]
The small disadvantaged business paid the required $185,000 application fee to ICANN, and has successfully completed an extended and detailed evaluation, requiring over $10 million in guaranteed committed funds, by ICANN.
planet.ECO LLC is the exclusive US Trademark holder of ECO(R) [2]. The company received and refused offers to license its .ECO trademark from both .ECO gTLD applicants, Big Room Inc. and Dot Eco LLC. planet.ECO LLC then filed Cease and Desist orders to stop the use and infringement of their .ECO Trademark. Both companies ignored orders and pursued infringing by marketing and campaigning for .ECO and used the .ECO trademark hundreds of times in the submission of their gTLD applications. Both companies also filed complaints for the cancellation of the .ECO trademark with the US Trademark Trial and Appeal Board. planet.ECO LLC then filed an infringement case against Big Room Inc. and Dot Eco LLC on March 2, 2012. Big Room Inc. and Dot Eco LLC then filed additional complaints for the cancellation of the .ECO trademark with the US Trademark Trial and Appeal Board before withdrawing all filings with the exception of one, which was withdrawn and dismissed with prejudice by the Trademark Trial and Appeal Board.
On August 10, 2015, in spite of numerous litigation filings for cancellation of the .ECO trademark, the United States Patent and Trademark office determined the .ECO trademark registration has met all registration requirements to be acknowledged as an Incontestable trademark - Section 15 of the Trademark Act, 15 U.S.C. §1065.
