Zak Muscovitch is a Domain Name Lawyer. He has been practicing domain name law for over a decade,[1] representing both domain name registrants and trademark owners in connection with domain name disputes.[2][3] He is a frequent participant on industry blogs, and in conferences and forums as a legal expert.
Career History[edit | edit source]
Mr. Muscovitch is the principal partner at The Muscovitch Law Firm,[4] and the founder of DNattorney.com; he founded the site in 1999. He has won historic and notable cases against Molson, Google, and Li Ka Shing, who is consistently ranked as one of the top 20 richest people in the world.[5][6][7]
He is considered Canada's leading domain name lawyer, having worked on more industry cases than any other lawyer in the country.[8] In 2010, he ran for an election for a seat in the CIRA board, [9][10] however, he was not elected. Mr. Muscovitch led the UDRP Panel, alongside Chef Patrick, at T.R.A.F.F.I.C. in 2010.[11]

Mr. Muscovitch was involved in the following historic legal cases:[12]
- Toronto.com (2000), successfully defended against the first attempt in Federal Court to obtain an interlocutory injunction against a domain name registrant
- SweetSuccess.com (2001), the first decision involving a Canadian registrar to establish the convenient forum for international domain name disputes.
- Technodome.com (2002), the first in rem decision under the U.S. ACPA.
- Canadian.biz (2002), the first Canadian court case overturning an ICANN UDRP (originally commenced by Molson)
- Shoes.biz (2002), the fist reverse domain name hijacking case for the .biz TLD.
- CheapTickets.ca (2003), first-ever successful defense to a CIRA complaint.
- CheapTickets.ca (2008), as defense he successfully obtained the cancelation of a plaintiff's trademark for "Cheap Tickets"; the proceeding went before the Federal Court of Appeals.
- ForSale.ca (2009), the first CIRA Reverse Domain Name Hijacking.
- LongRiver.com (IDN case), the first case of Reverse Domain Name Hijacking in an IDN (Chinese language) dispute; the complaint was brought by the billionaire Li Ka Shing to the ADNDRC and then to WIPO.
- Groovle.com, successfully defended against Google.com.
